General Release and Waiver of Claim for Mechanical Bull
In consideration of my participation as a participant in the activities held on (date below), whereby the undersigned will participate in Mechanical Bull Riding (herein referred to as “the activities”), I hereby represent and agree as follows:
I am voluntarily participating in the activities, which I understand may require physical exertion and entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activities.
I verify that I am physically fit and able to participate in the activities.
I hereby, for myself, my heirs, administrators, and executors covenant not to sue and release, waive and forever discharge, Corporate Gaming, Inc DBA Game On! their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (herein collectively referred to as “Releasees”), from all claims, demands, actions or causes of action, losses, damages, costs or injuries of whatever kind or nature, either in law or equity, arising from or by reason of any bodily injury or personal injuries known, unknown, death or property damage resulting from my participation in the activities whether caused by the negligence of any Releasees or otherwise or on account of first-aid or other medical treatment or service rendered during or as a result of my participation. I hereby, for myself, my heirs, administrators, and executors agree to indemnify and hold harmless the Releasees, from all liabilities, losses, damages or costs of any nature whatsoever (including court costs and legal fees) incurred by any Releasees as a result of my participation in the activities.
I hereby acknowledge that my participation in the activities is at my own risk and assume full responsibility for any bodily injury, death or property damage due to my negligence or otherwise while in or upon the specific or general area or location at which the activities will take place.
I hereby agree that this General Release and Waiver of Claim is intended to be as broad and inclusive as permitted by the laws of the State of Texas and, if any portion hereof is held invalid, the remainder shall continue in full legal force and effect.
